Wiretapping -- electronically intercepting conversations without the knowledge or consent of at least one of the participants -- has been a constitutional issue involving privacy and search and seizure over the past twenty years. Wiretapping and electronic eavesdropping are covered under federal law by the Federal Wiretap Act and by the Electronic Communications Privacy Act (ECPA), which cover both criminal and civil aspects.
