This work analyses the discretionary power of the ICC prosecutor and its scope. It explains that there is a tendency to overlook the necessity of distinguishing between the various usages of discretion when exercised as a power authorised by the law and effect when applying indeterminate legal thresholds. The author argues that the latter indeterminacy may give decision-makers an unwarranted opportunity to exercise a wide range of discretion, where extra-legal factors may be considered. In comparison, prosecutorial discretion allows decision-makers to consider extra-legal considerations. This book also discusses the relevance of political considerations within the decision-making process in the context of the exercise of prosecutorial discretion. It suggests that there need not be a conflict between the broad sense of justice as outlined in the statute and political factors in giving effect to decisions. This book will be of interest to students of international law, global governance and International Relations"-- $c Provided by publisher. 500 $a Based on author's thesis (doctoral - University of East London, 2016) issued under title: The role of the prosecutor in the International Criminal Court : discretion, legitimacy, and the politics of justice. 504 $a Includes bibliographical references and index. 505 0 $a The concept of discretion between law and politics -- Overview of the International Criminal Court -- The historical development of international criminal tribunals and the discretionary power of the prosecutor -- Gravity between prosecutorial and legal interpretive discretion -- In the interests of justice. 610 20 $a International Criminal Court. 610 27 $a International Criminal Court. $2 fast $0 (OCoLC)fst00744466 650 0 $a Prosecution (International law) $x Decision making. 776 08 $i Online version: $a Rashid, Farid Mohammed, 1981- $t Prosecutorial discretion in the International Criminal Court. $d Abingdon, Oxon ; New York, NY : Routledge, 2022 $z 9781003172086 $w (OCoLC)1256588331 $w (OCoLC)1256588331 830 0 $a Contemporary security studies. 941 $a 1 952 $l OVUX522 $d 20231021012226.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=13E438ACAF2611EC897049F049ECA4DBInitiate Another SILO Locator Search
