"Implicating the System: Judicial Discourses in the Sentencing of Indigenous Women" explores how judges navigate these issues in sentencing by examining related discourses in selected judgments from a review of 175 decisions. The feminist theory of the victimization-criminalization continuum informs Elspeth Kaiser-Derrick's work. She examines its overlap with the Gladue analysis, foregrounding decisions that effectively integrate gendered understandings of Indigenous women's victimization histories, and problematizing those with less contextualized reasoning. Ultimately, she contends that judicial use of the victimization-criminalization continuum deepens the Gladue analysis and augments its capacity to further its objectives of alternatives to incarceration. Kaiser-Derrick discusses how judicial discourses about victimization intersect with those about rehabilitation and treatment, and suggests associated problems, particularly where prison is characterized as a place of healing. Finally, she shows how recent incursions into judicial discretion, through legislative changes to the conditional sentencing regime that restrict the availability of alternatives to incarceration, are particularly concerning for Indigenous women in the system."-- $c Provided by publisher. 504 $a Includes bibliographical references and index. 505 0 $a Listening to what the criminal justice system hears -- Pathways through feminst theories, into the system -- Sentencing trauma : Gladue and the continuum, judicial navigations -- Incarceration wounds : judicial discourses about healing -- Refracted through institutional lenses. 530 $a Issued also in electronic formats. 650 0 $a Judgments, Criminal $x Social aspects $z Canada. 650 0 $a Indigenous women $x Legal status, laws, etc. $z Canada. 650 0 $a Indian women $x Legal status, laws, etc. $z Canada. 650 0 $a Sentences (Criminal procedure) $x Social aspects $z Canada. 650 0 $a Alternatives to imprisonment $z Canada. 650 0 $a Restorative justice $z Canada. 650 0 $a Discrimination in criminal justice administration $z Canada. 650 0 $a Indigenous women $z Canada $x Social conditions. 650 0 $a Indian women $z Canada $x Social conditions. 650 7 $a Alternatives to imprisonment. $2 fast $0 (OCoLC)fst00806191 650 7 $a Discrimination in criminal justice administration. $2 fast $0 (OCoLC)fst00895034 650 7 $a Restorative justice. $2 fast $0 (OCoLC)fst01096003 650 7 $a Sentences (Criminal procedure) $x Social aspects. $2 fast $0 (OCoLC)fst01112653 651 7 $a Canada. $2 fast $0 (OCoLC)fst01204310 776 08 $i Online version: $a Kaiser-Derrick, Elspeth, 1984- $t Implicating the system. $d Winnipeg, Manitoba : University of Manitoba Press, 2019 $z 9780887555558 $z 9780887555558 $w (OCoLC)1078787328 941 $a 1 952 $l OVUX522 $d 20200318012905.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=896658A81BE411EA82BF083097128E48Initiate Another SILO Locator Search
