Despite decades of targeted law reform, adult complainants still report that the process of being a witness is a significant point of re-victimisation. This book contains the findings of four years of research that compares the trial process in 30 adult rape cases from 2010 to 2015 (in which the defence at trial was consent) with 10 cases from the Sexual Violence Court Pilot heard in 2018. The aim of the research was to find out at which points in the questioning process the complainant displayed heightened emotionality, including distress, and why cross-examination (in particular) is so resistant to reform measures. Researchers also considered the extent to which the current rules of evidence and procedure are applied appropriately and consistently, and identified examples of best practice in order to develop proposals for changes to law and process. 650 0 $a Rape $x Law and legislation $z New Zealand. 650 0 $a Rape $z New Zealand. 650 0 $a Trials (Rape) $z New Zealand. 650 0 $a Fair trial $z New Zealand. 650 0 $a Evidence, Criminal $z New Zealand. 650 0 $a Adversary system (Law) $z New Zealand. 650 0 $a Law reform $z New Zealand. 650 7 $a Rape $x Law and legislation. $2 fast $0 (OCoLC)fst01921383 650 7 $a Law reform. $2 fast $0 (OCoLC)fst00994081 650 7 $a Adversary system (Law) $2 fast $0 (OCoLC)fst00797500 650 7 $a Evidence, Criminal. $2 fast $0 (OCoLC)fst00917210 650 7 $a Fair trial. $2 fast $0 (OCoLC)fst00919857 650 7 $a Rape. $2 fast $0 (OCoLC)fst01089970 650 7 $a Trials (Rape) $2 fast $0 (OCoLC)fst01156393 651 7 $a New Zealand. $2 fast $0 (OCoLC)fst01204542 700 1 $a Benton-Greig, Paulette, $e author. 700 1 $a Dickson, Sandra, $e author. 700 1 $a Souness, Rachel, $e author. 776 08 $i Online version: $a McDonald, Elisabeth. $t Rape myths as barriers to fair trial process. $d Christchurch, New Zealand : Canterbury University Press, 2020 $z 9781988503158 $w (OCoLC)1154473084 941 $a 1 952 $l OVUX522 $d 20220526014713.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=B5CC173A323411EC8B1165C359ECA4DBInitiate Another SILO Locator Search
