The book offers a new way of looking at the role of law in political transitions. Scholars and activists have long argued that prosecuting past atrocities promotes democracy in the wake of dictatorship. This view is, at best, overly simplistic. The two Germanys started in more or less the same place, politically speaking. Both practiced transitional justice extensively. Yet the results were diametrically opposed: democracy in the West, dictatorship in the East. Transitional justice does not necessarily produce only one kind of political outcome. It can be democratizing but it can also help build authoritarianism. The book shows how Nazi trials were "better" in the East than in the West, in that there were more of them, with more stringent sentences, and a more adequate theory of justice. Yet the eastern trials helped the new Stalinist dictatorship's claim to legitimacy. In the West, judges and lawyers defended Nazis in the name of liberal rights and the rule of law. This got Nazis off the hook, but it also promoted democracy. The politics of transitional justice can be paradoxical, creating unintended consequences and surprising outcomes"-- $c Provided by publisher. 650 0 $a War crime trials $z Germany $x History $y 20th century. 650 0 $a Transitional justice $z Germany $x History $y 20th century. 650 0 $a Transitional justice $z Germany (West) $x History $y 20th century. 650 0 $a Transitional justice $z Germany (East) $x History $y 20th century. 650 0 $a War crime trials $z Germany (West) $x History $y 20th century. 650 0 $a War crime trials $z Germany (East) $x History $y 20th century. 650 7 $a Transitional justice. $2 fast $0 (OCoLC)fst01747069 650 7 $a War crime trials. $2 fast $0 (OCoLC)fst01170459 651 7 $a Germany. $2 fast $0 (OCoLC)fst01210272 651 7 $a Germany (East) $2 fast $0 (OCoLC)fst01210274 651 7 $a Germany (West) $2 fast $0 (OCoLC)fst01210273 650 7 $a War crime trials $z Germany $x History $y 20th century. $2 nli 650 7 $a Transitional justice $z Germany $x History $y 20th century. $2 nli 650 7 $a Transitional justice $z Germany (West) $x History $y 20th century. $2 nli 650 7 $a Transitional justice $z Germany (East) $x History $y 20th century. $2 nli 650 7 $a War crime trials $z Germany (West) $x History $y 20th century. $2 nli 650 7 $a War crime trials $z Germany (East) $x History $y 20th century. $2 nli 648 7 $a 1900-1999 $2 fast 655 7 $a History. $2 fast $0 (OCoLC)fst01411628 776 08 $i Online version: $a Pendas, Devin O, 1966- $t Democracy, nazi trials and transitional justice in germany, 1945-1950 $d Cambridge, United Kingdom ; New York, NY : Cambridge University Press, 2020 $z 9781139021074 $w (DLC) 2020013019 941 $a 1 952 $l OVUX522 $d 20220526014430.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=0B4978C271B711EB8A4F4B2E3BECA4DBInitiate Another SILO Locator Search
