The book commences with an introduction of the concept of mens rea and controversies concerning this concept before national courts and ad hoc tribunals. This is followed by an examination of the definitional elements of mens rea at the ad hoc tribunals. The mens rea requirements for the specific liability modes applied at the ad hoc tribunals will be examined. Subsequently, definitional aspects of mens rea at the ICC will be discussed, and in particular the mens rea requirements for the specific liability modes as provided for in the Rome Statute. Separate chapters will address the mens rea requirements for the crimes listed in the Rome Statute: war crimes, genocide, crimes against humanity and the crime of aggression, respectively. An analysis of customary international law or the standards promulgated by the ad hoc tribunals will be used as examples where the ICC case law is scarce. A specific chapter will be devoted to mens rea requirements for political speeches. In some cases, certain speeches have been said to be catalysts of international crimes. Therefore, it is relevant to examine how the accused s intent was construed. The book will conclude with mens rea defenses in international criminal law, which will be specifically applied to the defenses listed in the Rome Statute."-- $c Back cover. 610 20 $a International Criminal Court. $0 http://id.loc.gov/authorities/names/no99002571 650 0 $a Criminal liability (International law) $0 http://id.loc.gov/authorities/subjects/sh85034081 650 0 $a Criminal intent. $0 http://id.loc.gov/authorities/subjects/sh85034041 610 24 $a International Criminal Court. 610 27 $a International Criminal Court. $2 fast $0 (OCoLC)fst00744466 650 7 $a Criminal intent. $2 fast $0 (OCoLC)fst00883192 650 7 $a Criminal liability (International law) $2 fast $0 (OCoLC)fst00883413 610 27 $a Internationaler Strafgerichtshof. $2 gnd $0 (DE-588)3042935-3 650 7 $a VoÌlkerrecht. $2 gnd $0 (DE-588)4063693-8 650 7 $a Subjektiver Tatbestand. $2 gnd $0 (DE-588)4694670-6 776 08 $i Online version: $a Knoops, Geert-Jan Alexander, 1960- author. $t Mens rea at the international criminal court. $d Leiden ; Boston : Brill, 2017 $z 9789004307889 $w (DLC) 2016041444 830 0 $a International criminal law series (Leiden, Netherlands) ; $v v. 10. $0 http://id.loc.gov/authorities/names/no2013007944 941 $a 1 952 $l OVUX522 $d 20231018021331.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=F1FABD20033911E8972C924897128E48Initiate Another SILO Locator Search
