Ex parte Milligan and the War on Terrorism: Testing the Constitutional Bedrock of a Civilian Criminal Trial / Jonathan Hafetz 520 $a "In 1869, Justice David Davis of the US Supreme Court decided Ex parte Milligan, which held that citizens could not be tried under military commissions while civilian courts were still open and there was no war. Beginning already with Ex parte McCardle (1869), however, the Court seemed to hem in the Milligan precedent and disregarded it in subsequent cases. By 1991, the case was declared "irrelevant." All of that changed with the War on Terror and the invasions of Afghanistan and Iraq. In defense of their use of military tribunals, the Bush administration cited cases like Ex parte Quirin (1942) that upheld the use of a military tribunal for Nazi saboteurs. Rejecting such arguments, the Supreme Court has cited Milligan in four decisions, revitalizing interest in a case that had long seemed all but overruled. In doing so, the Court also effectively characterized Reconstruction as a "war on terror"-a war on the terrorist insurgencies against the assertion of black freedom by the Republican Party, the Union Army, and African Americans themselves. Ex parte Milligan Reconsidered explores the precedential power of Milligan and the questions it poses about the Civil War, the War on Terror, and executive power"-- $c Provided by publisher. 600 10 $a Milligan, Lambdin P. $x Trials, litigation, etc. 600 17 $a Milligan, Lambdin P. $2 fast $0 (OCoLC)fst00467302 650 0 $a War and emergency powers $z United States $v Congresses. 650 0 $a Civil rights $z United States $x History $v Congresses. 650 0 $a Executive power $z United States $x History $v Congresses. 650 0 $a Civil supremacy over the military $z United States $x History $v Congresses. 650 0 $a Courts-martial and courts of inquiry $z United States $x History $v Congresses. 650 0 $a War on Terrorism, 2001-2009 $v Congresses. 650 7 $a Civil rights. $2 fast $0 (OCoLC)fst00862627 650 7 $a Civil supremacy over the military. $2 fast $0 (OCoLC)fst00862881 650 7 $a Courts-martial and courts of inquiry. $2 fast $0 (OCoLC)fst00881868 650 7 $a Executive power. $2 fast $0 (OCoLC)fst00917857 650 7 $a Trials. $2 fast $0 (OCoLC)fst01156290 650 7 $a War and emergency powers. $2 fast $0 (OCoLC)fst01170437 651 7 $a United States. $2 fast $0 (OCoLC)fst01204155 648 7 $a 2001-2009 $2 fast 653 $a Ex parte Milligan, 71 U.S. 2 (1866) 655 7 $a Conference papers and proceedings. $2 fast $0 (OCoLC)fst01423772 655 7 $a History. $2 fast $0 (OCoLC)fst01411628 700 1 $a Winger, Stewart Lance, $e editor. 700 1 $a White, Jonathan W., $d 1979- $e editor. 941 $a 2 952 $l OVUX522 $d 20210721015618.0 952 $l USUX851 $d 20210707013407.0 956 $a http://locator.silo.lib.ia.us/search.cgi?index_0=id&term_0=ED529BBEC7F211EAB1F2873797128E48Initiate Another SILO Locator Search
